Employment tribunal quarterly statistics for the period April to June 2022

7,659 single claims were received by employment tribunals in the period from April to June 2022 (20% less than in the same quarter in 2020), 6,465 single claims were disposed of (39.5% more than in the same quarter in 2020) and at the end of June 2022 there were 43,323 outstanding single claims (5.7% more than the figure at the end of the same quarter in 2021), according to statistics published by the Ministry of Justice (MOJ). During the same period, 11,742 multiple claims were received (2% less than in the same quarter in 2020), 8,241 multiple claims were disposed of (an increase of 267% compared to the same quarter in 2020), and 443,345 multiple claims were left outstanding at the end of June 2022 (2.6% less than the figure at the end of the same quarter in 2021).

 What are the implications?

MOJ report on tribunal statistics for the period April to June 2022 does not include receipts, disposal and caseload outstanding figures for the Employment Appeal Tribunal (EAT), and the report notes that in relation to employment tribunal data:

  • due to the migration of the employment tribunals to a new database during March to May 2021 it has not been possible to provide full results from both the original and replacement databases during the transition period on a consistent basis
  • the data is still subject to checks, but there is increasing confidence in the numbers for receipts, disposals and caseloads outstanding which are presented in the report
  • employment tribunal data for claims received and disposed of is not available for April to June 2021 (i.e. Q1 2021/22), and as a result comparisons for those figures are with the figures for April to June 2020
  • jurisdictional breakdowns, timeliness and outcome data are still undergoing more rigorous checks and will not be presented until the checks are complete—it is therefore not possible to ascertain, for example, whether cases are being disposed of more quickly, or are taking longer to be processed, than previous years
  • because of the operational differences between the new case management system and the previous database, caution should be exercised when making comparisons in the statistical results before and after migration.

The figures show a 5.7% increase in the number of single claims outstanding in the employment tribunals, compared to at the end of the same quarter in 2021 (from 42,124 to 43,323).

The number of multiple claims outstanding saw a decrease of 2.6% compared to the same quarter in 2021 (from 455,154 to 443,345). However, figures for multiple claims tend to be more volatile as they can contain a high number of claims against a single employer. It can therefore be difficult to discern any trend.

Employment tribunal figures for Q3 2021/22 have been revised due to a large spike in multiple claims disposals caused by a dismissal judgment issued in December 2021 for 48,000 British Airways claims which has only just been formally closed. The figures are expected to be revised again in the future.
