Employment Tribunals (Constitution and Rules of Procedure) (Amendment) Regulations 2024

Under SI 2024/366: Amendments are made to Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, SI 2013/1237, which sets out the rules that govern the procedure in the Employment Tribunals, including:

  • to allow the tribunal to direct that the 28-day time limit for the filing of a response restarts from the date the tribunal has sent a copy of the claim form to the respondent at an alternative address to that provided by the claim form;
  • to specify that in addition to the requirement for a response to be presented on the prescribed form and within the relevant time limit, it must also comply with any requirement specified by practice direction; and
  • to insert a new rule 92A to deem that a party or tribunal has complied with any requirement in the rules to send, deliver or present a document to the tribunal or another party, if they do so through the tribunal’s digital case management system, where this is in compliance with any practice direction.

These Regulations come into force on 6 April 2024.
